Welcome, and thank you for your interest in CoasterApp, Inc. (“Coaster”), and the CoasterService, as described in the CoasterUser Terms of Service (the “User Terms”) (available at www.usecoaster.com/tos. This Privacy Policy is incorporated into and is subject to the User Terms.

This Privacy Policy governs information you provide to Coaster or that we learn from your use of the Coaster Websites (“Sites”) and Service and your use of Coaster mobile application that allows you to place orders with participating merchants, or other products and services provided by Coaster (“Coaster Service”), Coaster’s collection of that information and how we use and in some instances share that information. By using any aspect of CoasterService, you expressly consent to the information handling practices described in this policy.

The Information Coaster Collects:

  • User-Provided Information:  You may provide to Coasterwhat is generally called “personally identifiable” information (such as your name, e-mail address, postal mailing address, home/mobile telephone number, payment account information, or demographic information) when using the CoasterService, such as when you register for the site, create a profile, or interact with Merchants using the CoasterService.  You will have the option to provide a photo of yourself and credit card information.
  • Location Information:  When you use the Coaster Service to place an order for goods or services at a participating merchant, we will be able collect information regarding your location and/or your intent to go to such location,
  • Purchasing History: When you use the Coaster service to place an order for goods or services at a participating merchant, we will collect information regarding the order, date, merchant establishment and transaction amounts. 
  • “Cookies” Information:  When you use the Coaster Sites, we may send one or more cookies– small text files containing a string of alphanumeric characters – to your computer.  Coaster may use both session cookies and persistent cookies.  A session cookie disappears after you close your browser.  A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Coaster Service.  Persistent cookies can be removed.  Please review your web browser “Help” file to learn the proper way to modify your cookie settings. Please note that if you delete, or choose not to accept, cookies from the Coaster Service, you may not be able to utilize the features of the Coaster Service to their fullest potential.
  • “Automatically Collected” Information:  When you use the Coaster Service or open one of our HTML emails, we may automatically record certain information from your web browser or mobile device by using different types of technology, including standard log files, “clear gifs” or “web beacons.”  This “automatically collected” information may include Internet Protocol address (“IP Address”) or other device address or ID, web browser and/or device type, the web pages, online services  or sites that you visit just before or just after the Coaster Service, the pages you view on the Coaster Service, and the dates and times that you visit the Coaster Service.
  • Linked Website Information: When you link an account you may have on a third party service to your Coaster account, such as when you use Facebook Connect to link Coaster to your Facebook account, Coaster may store the access credentials you provide, and will have access to and may collect any information you may have stored in connection with that account that you have configured that service to make available, including personally identifiable information and friends lists. By linking your accounts in this manner, you are authorizing Coaster as your agent to access and use your account on the third party service in connection with your use of the Website.
  • Third Party Web Beacons:  We may also implement third party content, such as advertising, on the Coaster service that uses “clear gifs” or “web beacons”, which allow the third party content provider to read and write cookies to your browser in connection with your viewing of that third party content displayed on the Coaster Service.  This information is collected directly by the third party, and Coaster does not participate in that data transmission. Information collected by third parties in this manner is subject to that third party’s own data collection, use, and disclosure policies.
  • Information from Other Sources: We may also obtain information, including personally identifiable information, from third parties and sources other than the Coaster Service, such as participating merchants, our partners or advertisers.  If we combine or associate information from other sources with personally identifiable information that we collect through the Coaster Service, we will treat the combined information as personally identifiable information in accordance with this Privacy Policy.

The Way Coaster Uses Information:

  • Coaster uses the information that you provide to enable the provision and purchase of goods and services that you have ordered from the participating merchant. 
  • Coaster uses the information you provide or that we collect to develop, operate, maintain, enhance, and provide all of the features and services found on the Coaster Service now and in the future
  • Coaster will use your email address to contact you for administrative or customer service purposes.
  • Coaster uses the information that you provide or that we collect to understand and analyze the usage trends and preferences of our users, to improve the way the Coaster Service works and looks, and to create new features and functionality.
  • Coaster may use “automatically collected” information and “cookies” information to:  (a) personalize our services, such as remembering your information so that you will not have to re-enter it during your visit or the next time you use the Coaster Service; (b) provide customized third party advertisements, content, and information; (c) monitor and analyze the effectiveness of the Coaster Service and third party marketing activities; (d) monitor aggregate site usage metrics such as total number of visitors and pages viewed; and (e) track your entries, submissions, and status in any promotions or other activities.
  • Coaster may use your email address or other personally identifiable information to send i) messages about the Coaster Service and ii) promotional messages related to the Coaster Service and the activities of third parties we work with. Generally, you have the ability to opt-out of receiving any such communications, either through links provided in the messages, or by updating your account preferences through the Coaster Service.

When Coaster Discloses Information to Others:

Coaster is not in the business of selling your information.  We do, however, disclose your personally identifiable information in a variety of circumstances in connection with developing and maintaining the Coaster Service and operating our business. For example:

·       Coaster works with third party service providers in the U.S. and other jurisdictions to provide website development, hosting, maintenance, and support as well as other business services for us.  To the extent it is necessary for these service providers to complete their work these third parties may have access to or process your personally identifiable information.  These disclosures are generally made under confidentiality terms, and the recipients are limited to using the information the purpose for which it was provided.

·       Information necessary to process the payment for the order will be provided to credit card processing parties and information necessary for the merchant to fulfill the order, and to identify you as the rightful recipient of the goods and services ordered by you will be provided to the merchant from whom you have ordered goods and services.    

·       The Coaster Service enables users to communicate in a variety of ways, including by placing an order with a participating merchant.  Any personally identifiable information that you voluntarily choose to include in a communication, such as by including a photograph with your order, and any personally identifiable information that you place in a publically accessible area of the Coaster Service will be available for use by others. Once you make your personally identifiable information available to others in any of these ways, it may be collected and used by the recipients without restriction.

·       Coaster may disclose automatically collected and other aggregate non-personally-identifiable information with interested third parties, to assist such parties in understanding the usage, viewing, and demographic patterns for certain programs, content, services, advertisements, promotions, and/or functionality on the Coaster Service.

·       Coaster may also disclose your information if required to do so by law or in the good-faith belief that such action is necessary or useful to comply with state and federal laws, to respond to a court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement activity.

·       Coaster works to promote a safe and reliable service for all users.  We reserve the right to disclose your information that we believe, in good faith, is appropriate or necessary to take precautions against liability; to protect Coaster and others from fraudulent, abusive, predatory, or unlawful uses or activity; to investigate and defend ourselves against any third party claims or allegations; to assist government enforcement agencies; to protect the security or integrity of the Coaster Service; or to protect or vindicate the rights, property, or personal safety of Coaster, our users, or others.

·            In the event that all or a portion of Coaster or its assets are acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information that we have collected from users in connection with such merger, acquisition, sale, or other change of control.

·       Coaster has no obligation to disclose to you that information has been provided to others under the circumstances described above.

Your Choices; Updating Personal Information:

You are responsible for maintaining the secrecy of your unique password and account information at all times.  You may, of course, decline to share certain personally identifiable information with Coaster, in which case Coaster may not be able to provide to you some or all of the features and functionality found on the Coaster Service

You may update, correct, or delete your personal information and preferences gathered through the registration process at any time by accessing your account preferences page through the Coaster Service. Please note that while your changes are reflected promptly in active user databases, we may retain all information you submit for a variety of purposes, including processing orders and associate payments, backups and archiving, prevention of fraud and abuse, and analytics. 

Please note also that once you have publicly shared information, it may be re-shared by other users, and your subsequent modification or removal of that information will not necessarily affect all copies previously propagated by others.

We may now or in the future make certain tools and features for configuring your privacy settings available to you through the Website, but any such features and settings we may provide do not guarantee the anonymity or confidentiality of any information, including personally identifiable information you provide or submit to the Website.

Third Party Services:

The Coaster Service may contain links to Web sites and services provided by third parties.  Any personally identifiable information you provide on third party sites or services is provided directly to that third party and is subject to that third party’s policies, if any, governing privacy and security. We are not responsible for the content or privacy and security practices and policies of third party sites or services to which links are displayed on the Coaster Service. We encourage you to learn about third parties’ privacy and security policies before providing them with personally identifiable information.

Data Security:

Coaster employs certain physical, managerial, and technical safeguards to help protect the integrity and security of your personally identifiable information.  Notwithstanding these efforts, we cannot, however, ensure or warrant the security of any information you transmit to Coaster, and you do so at your own risk.  Please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

If Coaster learns of a security systems breach, then we may attempt to notify you by the means you have provided to us to contact you through registration so that you can take appropriate protective steps. Coaster may post a notice through the Coaster Service if a security breach occurs.  Depending on where you live, you may have a legal right to receive notice of a security breach in writing.  To receive a free written notice of a security breach you should notify us at privacy@usecoaster.com.

We take reasonable steps to verify your identity before granting you account access, allowing your account to order goods and services or permitting changes to your information.  In addition, the devices that you have enabled to access the Coaster Service also have features that allow you to lock access to the device and we strongly encourage you to implement such features.  You are responsible for maintaining the secrecy of your unique password and account information at all times.

If you believe that your account has been improperly accessed or there have been unauthorized transactions made through your device, please promptly contact [security@usecoaster.com].

International Visitors:

The Coaster Service is intended solely for visitors located within the United States. If you nonetheless choose to use the Coaster Service from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personally identifiable information outside of those regions to the United States for storage and processing and by providing your personally identifiable information on the Coaster Service you consent to that transfer, storage, and processing. Further, we may transfer this data from the United States to other jurisdictions in connection with storage and processing of data, fulfilling your requests, and operating the Coaster Service.

Age Requirement and Children

This Coaster Service is not intended for use by any person under the age of 21. If you are under the age of 21, you may not register for or use the Coaster Service. Further, the Coaster Service does not intentionally or knowingly collect any personal information from children under the age of 13. If you are a child under the age of 13, you may not use or submit any information to the Coaster Service. If you are the parent or legal guardian of a child under the age of 13 and you believe such child has provided information to us, then please contact Coaster to have that child’s account terminated and information deleted via privacy@usecoaster.com.

Changes and Updates to this Privacy Policy:

Please revisit this page periodically to stay aware of any changes to this Privacy Policy, which may be revised from time to time at Coaster’s sole discretion, as provided in Section 9(a) of the Coaster User Terms of Use.  If we modify the Privacy Policy, we will make it available through the Coaster Service, and indicate the date of the latest revision.  In the event that the modifications materially alter your rights or obligations hereunder we will make reasonable efforts to notify you of the change.  For example, we may send a message to the email address provided by you, if we have one on file, or generate a notification when you access the Coaster Service for the first time after such material changes are made. 

Our amended Privacy Policy will automatically take effect 30 days after it is made available through the Coaster Service, except that we will not, without your consent, use your previously collected personally identifiable information in a manner inconsistent Privacy Policy in effect when we received that information unless you have affirmatively opted-in to allow us to do so.  If you do not agree with any changes to the Privacy Policy, you are free to terminate your account and/or cease use of the Coaster Service.  Your continued use of the Coaster Service after revised Privacy Policy has become effective indicates that you have read, understood and agreed to the current version of the Privacy Policy.
